Two Pines Outdoors - TERMS AND CONDITIONS
Please read this carefully, this is a legally binding contract.
AGREEMENT
The contract is between Two Pines Outdoors and another party, unless otherwise agreed and an internal Two Pines Outdoors document is compiled.
The contract comes into force when the other party places an order with Two Pines Outdoors. Orders must be in writing or be otherwise verifiable. When an order is related to several persons, e.g. a group, the terms are applicable to all participants.
Two Pines Outdoors reserves the right to select its co-contractors without explanation, e.g. a group entering into a contract with Two Pines Outdoors may include persons who may be excluded from a contract if the company sees that the co-contractor is a risk to the company’s reputation, goes against Two Pines Outdoors ideology, is illegal in Finland or is considered a risk in any other way.
Two Pines Outdoors reserves the right to cancel the contract, without explanation, if the company sees that the co-contractor is a risk to the company’s reputation, goes against Two Pines Outdoors ideology, is illegal in Finland or is considered a risk in any other way. If the contract is cancelled, the customer will be refunded.
All contracts comply with Finnish legislation and law.
PAYMENT
Full payment (100%) must be made 90 days before the consumer course/event begins. The customer is responsible for the payment. Two Pines Outdoors has no obligation to remind the customer of the payment.
A deposit may be requested to reserve your spot on a trip or course. This is non refundable but we may be able to move your deposit to a different trip if needed.
PRICE
Two Pines Outdoors will endeavour to maintain the quoted price. Should prices change due to circumstances beyond the control of Two Pines Outdoors (all third-party factors), the company shall inform the customer immediately. In such cases, the customer may cancel the order without charge. Two Pines Outdoors may not be held liable for any associated costs incurred by the customer arising from the cancellation, e.g. transport or accommodation.
TERMS OF CANCELLATION
Should the customer cancel an order, regardless of the reason, the following charges are liable:
cancellation between 90 and 60 days in advance, 30% refund;
cancellation 59-30 days in advance, 50% of the payment is refundable;
cancellation less than 30 days in advance, the customer is liable for the entire payment.
The buyer shall inform Two Pines Outdoors via e-mail at twopinesoutdoors@gmail.com. Two Pines Outdoors must confirm cancellations in writing. Confirmation shall be given within a reasonable time after receiving the cancellation.
All cancellation notifications must be submitted on working days (Monday to Friday), before 16:00 Finnish time. Cancellations received after this time will be considered to have been received on the next working day.
If an event/course must be moved due to the customer’s request, Two Pines Outdoors shall charge a transfer fee of EUR 300. If the cancellation is due to weather conditions, Two Pines Outdoors may decide to reduce the transfer fee by EUR 150.
If Two Pines Outdoors cancels/transfers an event, the customer is entitled to a full refund. Two Pines Outdoors may not be held liable for any associated costs incurred by the customer arising from the cancellation/transfer, e.g. transport or accommodation.
CHANGE OF DATE
If an event/course must be moved due to the customer’s request less than 30 days before the event/course, Two Pines Outdoors shall cTwo Pines Outdoors may decide to reduce the transfer fee by EUR 150.
If Two Pines Outdoors cancels/transfers an event, the customer is entitled to a full refund. Two Pines Outdoors may not be held liable for any associated costs incurred by the customer arising from the cancellation/transfer, e.g. transport or accommodation.
EVENT CHANGES BY Two Pines Outdoors
Due to their nature, events organized by Two Pines Outdoors are dependent on weather conditions. Weather conditions are not normally a basis for course changes, but if Two Pines Outdoors determines that weather conditions may cause excess strain or risk the implementation of the course, the company may change the initial course structure. Participants will be notified of such changes, but these changes are not grounds for a refund.
Two Pines Outdoors, at the discretion of the company, may alter a guide service’s plan, path or departure time if reasonably required
Should Two Pines Outdoors make changes that materially impact the nature of the product or service, the customer may:
accept the changes and continue using the changed product;
book an alternative product or service of equal or greater value if available (the customer is liable for the price difference);
book an alternative product or service of lesser value, if available (the price difference is paid to the customer);
ask for a full refund for the cancelled product.
the customer shall notify Two Pines Outdoors of the choice within five days after receiving the notice of the change. If the customer fails to notify Two Pines Outdoors within the required time, it will be deemed that the customer has accepted the change.
After the guide service has started, changes to the planned route may be unavoidable due to unforeseen conditions, practical problems or risks to the customer’s health and safety.
Changes shall consider the customer’s benefits and are at the discretion of Two Pines Outdoors.
EVENT CHANGES BY THE CUSTOMER
The customer shall notify Two Pines Outdoors of any possible changes via email at twopinesoutdoors@gmail.com. All booking changes must be made via e-mail.
Requested changes must be approved in writing by Two Pines Outdoors (via e-mail), and within a reasonable time.
All changes are subject to availability. Possible additional costs arising from the customer’s requested change will be charged to the customer. Cancellations of a tour, product or service included in a booking are not changes and cancellation terms will apply.
Changes are not permitted within 14 days of the start of an event unless otherwise specified.
PARTICIPANT’S RESPONSIBILITY AND OBLIGATIONS
All course participants shall:
follow the instructions provided;
follow good practices;
be tolerant towards other people, despite their differences;
Follow instructions provided by the instructors. Two Pines Outdoors is not responsible for instructions issued by third parties or damages caused by such instructions.
If a participant is acting as a guardian (parent, teacher, another guardian), he/she shall care for and monitor the appropriate under-age child/children.
Two Pines Outdoors may remove any participant from a course, without explanation or the person’s consent. Such situations may be e.g.:
A problem with supervising under-age participants;
substance use;
aggressive behavior/ other harmful behavior;
equipment defects / defects in the required information for the course;
health condition or deterioration of health.
Two Pines Outdoors has no obligation to refund persons removed from the trip.
Two Pines Outdoors may charge the removed persons for expenses related to their removal.
Customers are obliged to inform Two Pines Outdoors of the true state of their health when asked about it. Withholding such information releases Two Pines Outdoors of all health-related responsibility.
Two Pines Outdoors reserves the right to reject any person from participating in any guide service stage, if Two Pines Outdoors deems that the person’s physical or mental state renders them unfit to use Two Pines Outdoors products or services, or if the person’s participation could pose a risk to the person or others.
Customers who require continuous medication are responsible for it themselves.
ACCIDENTS
Generally, all Two Pines Outdoors events take place in nature and in natural conditions.
Two Pines Outdoors takes all possible action to avoid possible damages and accidents and is prepared for such events in the best possible manner.
The customer must be aware that accidents and injuries are always a possibility when participating in activities in nature.
The customer participates in Two Pines Outdoors events entirely at the customer’s own risk and accepts the possibility of accidents.
The customer must have valid accident insurance.
Should the accident be caused due to neglect on behalf of Two Pines Outdoors and it can be clearly shown as being caused by the company, Two Pines Outdoors can be held liable for compensation.
Two Pines Outdoors is not liable for participants’ equipment, clothes or valuables.
COMPLAINTS
If a participant is unhappy with the service received, he/she must immediately notify the company so the matter can be addressed.
Dissatisfaction with the level of service does not automatically entitle the customer to a reduced price.
In the lack of a 100% guaranteed service and no replacement service, the customer is entitled to expect Two Pines Outdoors to decide on reasonable compensation.
If the issue is not resolved during the event, the customer must submit a written complaint within 21 days after the event.
CHANGES TO THE TERMS OF CANCELLATION
Two Pines Outdoors reserves the right to amend these terms without separate notification.
